Despite speculations on the effects of the recent congressional decision on class actions, Equifax maintains that customers who have been affected by the breach can still sue them.

The embattled credit firm stated that enrolling in the free credit monitoring and identity theft protection service that they are offering will not prohibit customers from taking legal action, and the repeal of the rule which the CFPB had filed will not change the company’s position.

The rule, which the US Senate voted to remove, prevents financial companies that bind their customers by arbitration agreements from barring the latter from suing as a class.
