In a recent report, the EU’s Article 29 Working Party (WP29) said that it will issue a legal challenge to the EU-U.S. Privacy Shield pact if the US does not address their concerns on the agreement by the last quarter of 2018.

A review of the pact last September yielded satisfactory results, according to the EU Commission. However, concerns over the US government’s intrusive surveillance were also raised, with the Commission asking Washington to strengthen privacy protections in the Section 702 of the Foreign Intelligence Surveillance Act (FISA).

WP29 also asked that a Privacy Shield Ombudsperson be appointed May next year to address issues of EU citizens on US surveillance.
