
DOLE Releases Guidelines on 13th Month Pay
Pursuant to Presidential Decree No. 851, the Department of Labor and Employment (DOLE) released Labor Advisory No. 23 to serve as guidelines for the release of the 13th month pay for employees in the private sector. Covered are rank-and-file employees, regardless of their position, designation, or employment status, and those who are paid on piece-rate basis, fixed or guaranteed wage plus commission, with multiple employers, resigned or were terminated, and were on maternity leave and receive salary differential. The 13thmonth pay shall not be less than 1/12 of the total basic salary earned by the employee within a calendar year, unless an existing company practice or policy, employment contract, or collective bargaining agreement provides for a higher amount. Said 13th month pay must be paid on or before December 24, 2022.
