ICANN Looking to Appeal Whois Case with European Court of Justice

In a blog post this week, California-based non-profit ICANN said that may appeal its ongoing Whois case to the European Court of Justice if the Higher Regional Court does not rule in its favor.
The statement came across as “bizarre” since it is usually to the advantage of appellants to show some modicum of respect to a court they are appealing to and wait for that court’s judgment before talking about an appeal to a higher court.
The domain overseer is expected to spend millions should it pursue arguing its GDPR case at the ECJ rather than to fix its internal disagreements.
