
Russia Seeks Dismissal of DNC Lawsuit, Cites International Conventions

The Russian Federation sought this week the dismissal of a lawsuit filed by the Democratic National Committee which accuses the Russian state and its military intelligence of carrying out cyberattacks on DNC servers in 2016.
The DNC also said that Russia had leaked data benefitting Trump’s presidential campaign via WikiLeaks.
However, the Russian Federation said that under the US Foreign Sovereign Immunities Act (“FSIA”), foreign sovereign States enjoy absolute jurisdictional immunity from suit unless a plaintiff can demonstrate that one of the FSIA’s enumerated ‘exceptions’ applies’. The Federation also argued that such incidents are considered “State-to-State matters” and should be resolved between governments.
